Trademark Registration

Copycat channels, fake merch, someone else registering your name first — these are real risks once your name has an audience. Trademark registration makes your channel name, logo or tagline legally yours.

When you need this

  • Your channel or page name is gaining traction and imitators are appearing.
  • You're launching merch, a podcast, a course, or any product under your creator brand.
  • You've received a legal notice claiming your name infringes someone else's mark.
  • A brand deal or platform program requires proof that you own your brand name.
  • You want to stop squatters before they register your name in your own category.

What we do

  • Comprehensive trademark search across the Indian Trade Marks Registry records — before you fall in love with a name that's taken.
  • Advice on the right classes for creators (commonly Class 41 for entertainment/education content, Class 9 for digital media, Class 35 for advertising/merch retail, Class 38 for streaming).
  • Preparing and filing your application with the Trade Marks Registry, as individual, startup or company — whichever gets you the right fee slab.
  • Responding to examination reports and objections, and handling oppositions if a third party challenges your mark.
  • Monitoring and renewal reminders so your registration never lapses.

How it works

  1. 1

    Search & clearance

We check whether your name is available and flag conflicts before filing.

  2. 2

    Class strategy

We pick the classes that actually cover what you do — not a copy-paste list.

  3. 3

    Filing

Application filed with the Trade Marks Registry; you can use ™ immediately.

  4. 4

    Prosecution to registration

We handle examination replies and objections until your ® is granted.

Good to know

You can use ™ as soon as you claim the mark; ® is only for registered marks — using ® without registration is an offence.

Government fees are lower for individuals, startups and small enterprises (₹4,500 per class filed online) than for other entities (₹9,000) — filing in the right capacity matters.

A smooth application typically registers in 8–18 months; objections are common and are a routine part of the process, not a rejection.

Registration lasts 10 years and is renewable indefinitely — your channel name can outlive any platform.

Frequently asked

Can I trademark my YouTube channel or Instagram handle?

Yes — channel names, creator names, logos and taglines are all registrable if they're distinctive and available. What you're registering is the brand name, independent of any platform.

Someone copied my channel name. Can I stop them?

With a registered trademark, you have a clear statutory right to act — platform complaints, cease-and-desist notices, and infringement action. Without registration you may still have "passing off" rights if you can prove reputation, but it's a harder, more expensive fight. Registering first is far cheaper.

Which class should a creator file in?

Most creators start with Class 41 (entertainment and education services). Merch adds Class 35 and product classes like 25 (clothing); apps and downloadable content add Class 9. We recommend the minimal set that covers your actual activity and near-term plans.

What if my application gets objected?

Most applications receive an examination report — it's routine. We draft the reply, attend hearings if needed, and push the application through. An objection is the start of a conversation, not the end of one.
